Hacienda Del Sol is pleased to provide you, the Guest, retreats, services, and accommodations per the terms and conditions set out below.

AGREEMENT TO TERMS:
Please read these published Terms & Conditions thoroughly. By making any form of payment, you, the Guest, acknowledge that you have read, understood, and agreed to these Terms & Conditions.

STANDARD BOOKING POLICY
At Hacienda Del Sol, we believe planning your restoration should be as stress-free as possible. We understand life’s demands can shift, and we want you to book your transformative retreat with confidence. Our policies below offer clear options for cancellations and date changes, designed to provide you with upfront peace of mind.

Booking Cancellation Policy:
All cancellations must be made and acknowledged in writing by email to our Reservations Department to be valid. Due to the individualized preparation we devote to each guest and the limited capacity of our retreat, the following cancellation terms apply:

  • 30 Days or More Notice: If you cancel your booking at least 30 days prior to your arrival date, you will receive a refund, subject to a 10% administrative charge on the refunded amount.
  • Less Than 30 Days Notice: If you cancel your booking less than 30 days prior to your arrival date, you will receive a refund equivalent to 50% of the services contracted during the booking process.
  • Within 48 Hours of Arrival: For cancellations made within 48 hours of your arrival date, no refunds will be provided.
  • Early Departure: In the event of early departure from your initially contracted stay, no refunds will be provided.
  • Unused Services: If you choose not to receive any part of the inclusions provided in your reservation, no refunds will be provided.

Booking Modification Policy (Date Changes):
To provide you with flexibility, we offer clear options for date changes.

  • Date Changes More Than 30 days from Arrival: If you need to change your arrival date more than 30 calendar days before your original arrival, you’re allowed a one-time date change after your initial booking without charge.
  • Date Changes Less Than 30 days from Arrival: If you need to change your arrival date less than 30 calendar days before your arrival, you’re allowed a one-time date change after your initial booking for a 10% rebooking fee.

Important Considerations for All Date Changes:

  • Subsequent Changes: While we offer an initial date change, please be aware that any additional date changes beyond the first (a second change or more) will be subject to the terms above plus incur a $500 administration fee.
  • Availability: All new dates are dependent on our availability at the time you request the change.
  • Rate Season & Pricing: Your new dates don’t need to be in the same rate season as your original booking. However, if your rescheduled dates fall into a different rate season, your booking may be subject to price increases based on the listed prices on our website at the time of your rebooking.
  • No Refunds for Lower Rates: Should your rescheduled dates fall into a rate season with a lower price, please understand that the difference will not be refunded or issued as a credit. We encourage guests to consider this when selecting new dates across different rate seasons.
  • Payment for Changes: Any applicable increase in price due to a different rate season, administration fee, or rebooking fee must be paid when you make the change.
  • Time Limit: Your new arrival date must be within 12 months of your original reservation date.
  • No Other Modifications: We can only process date changes; no other modifications to your reservation are allowed at the time of a date change.
  • Confirming Your New Dates: You must confirm your new start date when you make the change. We are unable to hold retreat credits on file for undetermined future bookings.

RESERVATIONS & PAYMENTS

  • Payment Schedule: Payments are due in full at the time of booking to secure your reservation.
  • Currency & Accepted Payments: All prices listed on our website and in all documents are in US dollars. We accept USD payments in the form of PayPal or Credit Card. We do not accept direct deposits.
  • Costa Rican VAT: All payments (reservations & incidentals) are subject to Costa Rica’s mandatory 13% Value Added Tax (VAT) and will be applied at check-out.

TRAVEL INSURANCE
We understand that unforeseen circumstances can sometimes disrupt even the best-laid plans. While we aim to be flexible with our Booking Cancellation and Modification Policies, it’s important to be aware of the situations where refunds are not be possible.

For this reason, securing comprehensive travel insurance is essential. We strongly recommend purchasing travel insurance, particularly a “Cancel for Any Reason” policy, to protect your investment. This type of coverage can provide reimbursement for non-refundable expenses, including your booking with us, in situations such as:

  • Last-minute cancellations (e.g., within 30 days of arrival, where a 50% charge of contracted services applies, or less than 48 hours where no refunds are provided).
  • Early departures (should you need to leave before your scheduled departure date, where 100% of the booking costs are applied with no refund).
  • Medical emergencies or illness, including situations where you get sick on-site, have a medical emergency, or an accident.
  • Family emergencies or death in the family.
  • Flight cancellations, delays, or other travel disruptions.
  • Any personal reason preventing your attendance or requiring early departure.

Given the individualised nature of our Wellness Center and all-inclusive programs, Hacienda del Sol is unable to offer refunds for these types of unforeseen circumstances. We encourage you to research and select a policy that provides adequate coverage for your specific needs.

FORCE MAJEURE
Hacienda del Sol shall not be liable for delays in performance of any obligation under this Trip Reservation that is caused by an act or occurrence beyond our control, including but not limited to acts of God, global pandemics or regional epidemics, war, civil disturbance, or extreme local weather conditions (a “Force Majeure Event”) that prevents our ability to perform our contractual obligations.

If a Force Majeure Event occurs, the performance of our contractual obligations shall be excused for the period of delay resulting from the Force Majeure Event. If you are affected by a Force Majeure Event and our performance of obligations under this Trip Reservation is delayed, Hacienda Del Sol will use commercially reasonable efforts to reschedule your trip within 12 months of your original arrival date.

If we are unable to reschedule your trip within 12 months, Hacienda Del Sol will offer you a credit voucher to apply toward your future trip. This credit voucher will cover the total amount paid directly to Hacienda Del Sol for the accommodation portion of your stay, excluding any third-party costs (e.g., flights, separate tours, personal expenses). The cost of your future stay may be subject to payment differentials depending on our standard rates at the time of your reschedule.

GUEST CONDUCT & PROPERTY POLICIES

  • Age Requirements: Guests must be 18 years of age or older. Guests aged 15 to 17 years are welcome when accompanied by a legal adult guardian.
  • No Pet Policy: For the comfort and safety of all our guests, Hacienda del Sol operates a no-pet policy. Service animals, as defined by applicable law, are exempt from this policy. Guests requiring the presence of a service animal must notify Hacienda del Sol prior to arrival.
  • No Smoking Policy: Smoking is not permitted anywhere on resort property.
  • Disturbance, Drug, & Alcohol Policy: You acknowledge and agree that whenever present on the Property or participating in an activity organized by Hacienda Del Sol, neither you nor members of your party will be impaired by any substance, including, but not limited to, alcohol, cannabis, illegal drugs, and other controlled substances. Hacienda Del Sol reserves the right to deny participation to anyone that appears to be in contravention of its Drug & Alcohol Policy without refund. Hacienda del Sol also reserves the right to deny participation to anyone who is disturbing staff or other guests without refund. This includes, but is not limited to, behaving in a disruptive or disorderly manner, physical abuse, being disrespectful to other guests and/or staff, etc.

BUNGALOW POLICY
Your selected bungalow type is guaranteed. However, due to the small size of the property, a one-time change during your stay may be necessary to maintain the integrity of your booking, especially for delayed reservations. If a change is required, you will be notified before your arrival.

ENHANCEMENT FEE POLICY
Hacienda del Sol is pleased to offer the Guest arrangement of additional activities and excursions ‘a la carte,’ but the guest is responsible for the additional cost of these activities. The guest is responsible for the full payment of any spa treatments or extra activities (tours, etc.) booked that are canceled within 24 hours of the event.

CHANGES & ENHANCEMENTS TO PROGRAMS, SERVICES, AND PROPERTY
Please note that with our continued focus on wellness innovation, our programs, services, daily activities schedule, and property are subject to changes and enhancements without prior notice. These updates will always be aligned with our signature wellness methodology and the integrity of our operations.

ACCESSIBILITY INFORMATION
Due to the unique and natural landscape of our location, Hacienda del Sol is not designed to be fully accessible for individuals with mobility impairments or other specific accessibility needs. Our property features varying terrain, steps, and older architectural elements that may present challenges. We strongly advise guests with accessibility requirements to contact us directly before booking to discuss the specific layout and features of our property and ensure it meets your individual needs.

VALUABLES
We are not responsible for your valuables. We provide you a laptop-sized safe, and it is your responsibility to keep your valuables there. You are fully responsible for your valuables.

DAMAGE TO PROPERTY
Guests agree that they will be charged if they damage Hacienda del Sol property. This includes, but is not limited to, smoking in the bungalows, soiling linens, towels, pillows, or damaging furniture, curtains, etc.

MEDICAL WAIVER & RELEASE OF LIABILITY POLICY
You agree that Hacienda del Sol is NOT a medical facility, and we do not give medical advice. All participants are responsible to get clearance from their doctor before participating in any of our programs.

Furthermore, Hacienda del Sol is 3 hours from the closest hospital and 45 minutes from the closest clinic; therefore, participants with health conditions that require fast access to health care should take that into consideration before making a reservation.

While Hacienda del Sol is not responsible for contraindications and their effects from any medications or supplements you are taking before or during your stay with us, you are responsible for disclosing to your retreat facilitator any medications or supplements you are on. This information will be kept confidential.

In the event that you should require medical care or treatment, you authorize Hacienda del Sol to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel.

You further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. You are aware and understand that you should carry your own health insurance.

You acknowledge you will be required to sign a ‘Medical Waiver and Release of Liability Agreement’ in written format prior to or upon arrival to Hacienda Del Sol.

GOVERNING LAW
These Terms and Conditions and all written agreements with Hacienda del Sol shall be governed, construed, and interpreted in accordance with the Laws of Costa Rica.
